...got there in the end though!! CH levering the door jamb with a hammer (best we had to hand) and me giving the door a few 'sokuto' kicks from my 20yrs ago karate experience!! ...a bit concerned that none of my neighbours popped their heads out to see what all the noise was all about!!!?

My pay cheque from my old job has been returned; theyce stoopped the payment, now i know they cant do this as its for the week i worked before i left them!
They are also witholding my p45, any advice? I need that money and my p45

P45 doesn't belong to you, it belongs to the Tax Office and your employer is breaking the law by witholding it. I once had an employer that did exactly the same. I informed the tax office who sent me a new P45 staight away. The lost wages I just wrote off and put it down to experience. Were you being paid directly into a bank account? If not you might even have trouble proving that you weren't paid in the first place!

CAB would be my 1st port of call. and i think you can fill in some other form if you dont have a P45?

Cheers hun, the cheque has been sent back to me from our bank, has my name on it etc and its alos a buisness cheque, and its stamped on it "Payment stopped"

I would certainly phone to ask why, it may just be a miscalculation of your final payment....I used to work in a payroll department and we would some times hold back on someones last pay cheque if they had not given back all of our company equipment so I don't know if this would apply to you..... but once issued I don't think a cheque was ever stopped.

If you don't have a P45 you can, indeed, fill in a P46, but you'll go onto emergency tax whilst it all gets sorted out.

nope was goona go and get a m8's bike out and abuse that as im still waiting for metal plate to be delivered so i can get on with fitting new underseat pipe

So you never had a contract of employment??

You would know if you had as you have to sign it as part of the contract Confused

The next thing is, did you have payslips? if so you would have paid tax and NI on your weely/monthly pay which would be a record of your working there.

If not then i dare say you were cash in hand in which case you and your employer have broken the law, not only this you will have no proof of ever working there and they would know this which means you have no leg to stand on so to speak to claim anything back! Confused Shocked
